In a unanimous ruling by a three-judge panel, the Indiana Court of Appeals overturned an Allen Superior Court judge's decision to dismiss the lawsuit against the popular social media app. Writing for the panel, Judge Paul Mathias said the state does have jurisdiction over the company.

Almost a year after the case was filed in Allen County Superior Court by Indiana Attorney General Todd Rokita, Judge Jennifer DeGroote ruled the court does not have any jurisdiction over the China-based company and that it has not violated Indiana's laws.

Allen Superior Court Judge Jennifer DeGroote heard oral arguments from lawyers on both sides. She said she will rule on the matter by the end of November.

Attorneys for the social media company argue Indiana Attorney General Todd Rokita has no authority to sue them in state court, nor have they violated a law protecting consumers since their app is free to download and use.

Rokita claims those who join him in the fight against the social media company are "patriots."

In her order, U.S. District Judge Holly Brady described Indiana Attorney General Todd Rokita's arguments as "irrelevant posturing."
